Terms of Service - Maya - AI Companion & Chat

Read the Terms of Service for Maya app. Understand your rights, responsibilities, and the rules governing your use of Maya app.

These Terms of Service ("Terms") govern your access to and use of the mobile application "Maya – AI companion & chat" ("App", "Service"), operated by MANAN SHARMA operating as GLITCHMIND TECHNOLOGIES ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility and Age Requirement

1.1 You must be at least 18 years old to use this App. The App contains mature, suggestive, and adult-oriented conversational and visual content ("Spicy Mode") that is not suitable for minors.

1.2 By using the App, you represent and warrant that:

  • You are 18 years of age or older;

  • You have the legal capacity to enter into these Terms under the laws of your jurisdiction;

  • Your use of the App, including any Spicy Mode features, does not violate any law applicable to you.

    1.3 If we become aware that a user is under 18, we reserve the right to immediately suspend or terminate that user's access without notice.

2. Nature of the Service — AI-Generated Content

2.1 Maya provides interactions with artificial intelligence (AI) characters ("AI Companions"). All AI Companions are entirely fictional, computer-generated personas. They are not real people, do not represent any real or identifiable individual, living or dead, and have no consciousness, feelings, or independent existence.

2.2 All text responses and images generated within the App are produced by AI models (including third-party AI providers) and are synthetic, AI-generated content. Outputs may be inaccurate, unrealistic, repetitive, or inconsistent. We do not guarantee the accuracy, quality, or appropriateness of any AI-generated output.

2.3 You acknowledge that interactions with AI Companions are not a substitute for real human relationships, companionship, emotional support, or professional advice (including but not limited to mental health, medical, financial, or legal advice). If you are experiencing distress, please seek support from a qualified professional or a trusted person in your life.

2.4 We do not pre-screen every AI-generated response or image before it is shown to you. While we apply content filters and safety guardrails, AI systems can occasionally produce unexpected or undesired output. Use of any feature that allows you to influence AI output (including chat messages and image prompts) is governed by Section 6 below.

3. Account, Device Identification, and Data

3.1 The App does not require account registration (no email, phone number, or password). Instead, your in-app profile, virtual currency balance, unlocked content, streaks, and subscription status are linked to your device identifier (Android ID) and related device information.

3.2 Because your data is tied to your device identifier, your coin balance, unlocked models, streaks, and purchase history will persist across reinstalls as long as your device's Android ID remains unchanged. However, if you switch devices, factory reset your device, or your Android ID otherwise changes (which may happen due to OS updates or device settings), your previous data cannot be recovered, except for purchases that can be restored via your Google Play account where applicable.

3.3 We collect certain device and technical information (device ID, OS, app version, device brand/model/manufacturer, OS build/version, device type, advertising ID, and UTM parameters) to operate, secure, and improve the Service, and for analytics and advertising purposes, as described in our Privacy Policy [/legal/privacy-policy].

3.4 You may request deletion of the data associated with your device identifier at any time. Instructions are provided in Section 12 and in our Privacy Policy.

4. Virtual Currency ("Coins")

4.1 Coins are a limited, non-transferable, virtual license to access certain features within the App (e.g., unlocking AI Companions, enabling Spicy Mode without ads, requesting AI-generated images). Coins are not currency, property, or money, have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred between accounts, devices, or users.

4.2 Coins may be obtained through: (a) purchase via in-app purchase bundles, (b) daily streak rewards, (c) completing in-app game levels, or (d) watching rewarded advertisements.

4.3 Coins, once consumed (e.g., to unlock a model or generate an image), are non-refundable, except where required by applicable consumer protection law or Google Play's refund policy.

4.4 We reserve the right, at our sole discretion and at any time without prior notice, to modify the coin economy, including but not limited to: the cost of unlocking any AI Companion, daily streak reward amounts, rewarded ad payouts, game level rewards, coin bundle pricing and quantities, and premium subscription pricing and benefits. Such changes apply prospectively and do not entitle you to a refund or compensation for previously consumed coins.

4.5 We reserve the right to suspend, adjust, or revoke coin balances in cases of suspected fraud, exploitation of bugs, chargebacks, or violation of these Terms.

5. Subscriptions, Purchases, and Billing

5.1 The App offers optional premium subscriptions (weekly, monthly, and/or yearly) and one-time coin bundle purchases, processed through the app store's billing system and a third-party subscription management service.

5.2 Current premium subscription benefits may include: unlocking all AI Companion models, enabling Spicy Mode without ads, discounted coin generation, and an ad-free experience. The specific features, pricing, and discount levels included in premium may change over time at our discretion; the version of benefits active at the time of your billing cycle applies.

5.3 Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with Google Play's subscription policies. You can manage or cancel your subscription through your Google Play account settings — we do not have the ability to cancel subscriptions on your behalf.

5.4 All payments are processed by Google Play. Refunds are subject to Google Play's refund policies, not ours. We do not directly process or guarantee refunds for purchases made through the Play Store.

5.5 Prices for coin bundles and subscriptions may vary by region, currency, and applicable taxes, and may change at any time without prior notice. Changes will not affect purchases already completed.

6. User Conduct and Prohibited Use

By using the App, including chat and image-generation features, you agree that you will NOT:

6.1 Submit, request, or attempt to generate any prompt, message, or content that:

  • Depicts, references, or implies minors (anyone under 18) in any sexual, suggestive, or romantic context, regardless of how the request is phrased;

  • Depicts real, identifiable individuals (celebrities, private individuals, etc.) in sexual, suggestive, defamatory, or non-consensual contexts;

  • Constitutes non-consensual sexual content, sexual violence, incest, bestiality, or any other content prohibited under applicable law or Google Play's policies;

  • Promotes, depicts, or facilitates illegal acts, self-harm, suicide, eating disorders, terrorism, hate speech, or discrimination based on race, religion, gender, sexual orientation, or other protected characteristics;

  • Infringes the intellectual property, privacy, or publicity rights of any third party.

    6.2 Attempt to circumvent, disable, reverse-engineer, or interfere with any age-gating, content filter, safety guardrail, or moderation system implemented in the App.

    6.3 Use automated means (bots, scripts, scrapers) to interact with the App, exploit bugs for unintended coin/reward gains, or attempt to manipulate the in-app economy.

    6.4 Use the App in any manner that violates applicable local, state, national, or international law.

    6.5 Consequences of violation: We reserve the right, at our sole discretion and without prior notice, to filter, block, or refuse to process any prompt or message; suspend or permanently ban your access to the App (by device identifier or other means); and/or report unlawful content (including any content involving minors) to relevant law enforcement authorities, as required or permitted by law.

7. Generated Content — Ownership and License

7.1 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to view and store on your personal device the text and image content generated for you during your use of the App, for your personal, non-commercial use only.

7.2 You may not redistribute, sell, sublicense, publicly display, or commercially exploit any AI-generated content obtained through the App without our prior written consent.

7.3 We make no representation regarding the ownership or copyright status of AI-generated outputs and disclaim any liability arising from your use, sharing, or distribution of such content outside the App.

7.4 We reserve the right to use anonymized or aggregated data derived from your interactions (not including the literal content of your private chats or generated images, except as described in our Privacy Policy) to improve the Service.

8. Advertising

8.1 The App displays banner, interstitial, and rewarded advertisements served through third-party ad networks. Rewarded ads may be required to access certain features (e.g., temporary Spicy Mode access, game hints/skips, bonus coins).

8.2 We are not responsible for the content of third-party advertisements. Your interactions with advertisements are subject to the respective ad network's and advertiser's terms and privacy policies.

8.3 Premium subscribers may receive an ad-free experience as described in Section 5.

9. Third-Party Services

The App relies on third-party service providers to operate, including but not limited to: AI chat and image generation providers, database and backend infrastructure providers, analytics providers, advertising networks, and payment/subscription management services.

9.2 Your chat messages and image prompts may be transmitted to these third-party AI providers for the sole purpose of generating responses/images. We do not control these providers' systems and are not responsible for their availability, output quality, or any temporary or permanent unavailability of the Service resulting from their actions.

9.3 We may change, add, or remove third-party providers at any time without notice.

10. Intellectual Property

10.1 The App, including its design, branding ("Maya"), AI Companion character designs/configurations, software, and all associated intellectual property (excluding AI-generated outputs and third-party content) are owned by us or our licensors and are protected by applicable intellectual property laws.

10.2 You may not copy, modify, distribute, sell, or lease any part of the App, nor reverse-engineer or attempt to extract the source code, except as permitted by applicable law.

11. Disclaimers and Limitation of Liability

11.1 THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.

11.2 We do not guarantee uninterrupted, error-free, or secure access to the App, and we do not guarantee that any specific AI Companion, feature, coin value, or premium benefit will remain available or unchanged.

11.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA (INCLUDING COIN BALANCES, STREAKS, OR UNLOCKED CONTENT), LOSS OF PROFITS, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE APP OR ANY AI-GENERATED CONTENT.

11.4 OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Data Deletion

You may request deletion of all data associated with your device identifier by:

  • Submitting a request via email (refer to privacy policy).

Upon a verified request, we will delete your coin balance, unlock status, streak data, and associated device information from our servers within 30 days, except where retention is required for legal, security, or fraud-prevention purposes. Note that data stored locally on your device (chats, generated images) is not affected by this request and must be removed by uninstalling the App or clearing app data.

13. Termination

13.1 You may stop using the App at any time by uninstalling it.

13.2 We may suspend or terminate your access to the App (in whole or in part), including by blocking your device identifier, at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or abuse of the Service.

13.3 Upon termination, your right to use the App ceases immediately. Coin balances, premium subscriptions, and unlocked content associated with a terminated profile may be forfeited without compensation, except where prohibited by law.

14. Changes to the Service and These Terms

14.1 We may modify, suspend, or discontinue the App (or any feature, AI Companion, game, or reward mechanism within it) at any time, with or without notice.

14.2 We may update these Terms from time to time. The "Last Updated" date at the top will reflect the most recent revision. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If changes are material, we will make reasonable efforts to notify you (e.g., via an in-app notice).

15. Governing Law and Dispute Resolution

15.1 These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

15.2 Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India, subject to applicable consumer protection laws that may grant you rights to bring claims in your local jurisdiction.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
